Motion to Reopen or Reconsider
A motion to
reopen is a type of review procedure, which may be used as an
alternative to an appeal in various types of cases, and is governed by
local laws that vary by jurisdiction. Such a motion may be used to
correct an error of law, an error of interpretation, or simply a wrong
decision, instead of a lengthy and expensive appeal that may not be the
best option for the client. For example, in immigration law, the
officials may allow reopening for adjustment, in the exercise of
discretion, when certain conditions are met
If you have an approved immigrant visa petition and are currently
residing in the United States, you may be eligible for an adjustment of
status.
Adjustment of Status, which is processed through the United States
Customs and Immigration Services (USCIS) is available only to persons
currently living in the U.S.
According to USCIS:
An immigrant
is a foreign national who has been granted the privilege
of living and working permanently in the United States. You must go
through a multi-step process to become an immigrant. In most cases,
USCIS must first approve an immigrant petition for you, usually filed
by an employer or relative. Then, an immigrant visa number must be
available to you, even if you are already in the United States. After
that, if you are already in the United States, you may apply to adjust to permanent resident
status

the local U.S. consulate to complete the processing for an immigrant
visa.)
